    CHAPTER 1. DISCIPLINARY POLICIES
    Section 1. Disciplinary Authority
    Disciplinary Authority shall be vested in members of the:
    • Office of the Joint Staff Inspector General (OJSIG) and US Special Operations Command (USSOCOM) for most policy violations;
    • Members of the Office of the Secretary of Defense (OSD) and the Joint Staff Directorate (JSD), following the conditions established in the applicable Regulations;
    • National Security Council (NSC);
    • Commissioned Officers, to the extent and under the conditions explicitly prescribed in applicable Regulations; and,
    • Office of the Judge Advocate General (OJAG), which shall possess the independent authority to review, affirm, modify, or overturn disciplinary actions subject to the criteria outlined in this Regulation.
    SUBSECTION 1. Office of the Joint Staff Inspector General (OJSIG) and US Special Operations Command (USSOCOM)
    The Office of the Joint Staff Inspector General (OJSIG) is responsible for the ongoing enforcement of this regulation, for as long as these articles remain in effect.
    • Members of the OJSIG shall act under the authority of the Joint Staff Inspector General (JSIG), who shall possess discretionary authority to impose sanctions for violations of established policy and to administer disciplinary measures across the entirety of the USDF.
    Formal investigations shall be conducted exclusively by members of the OJSIG and USSOCOM.

    The OJSIG and USSOCOM may issue any disciplinary measure authorized by this Regulation when such action is deemed necessary to maintain good order and discipline or to address violations of policy.

    SUBSECTION 2. Joint Staff Directorate (JSD) and Office of the Secretary of Defense (OSD)
    Members of the JSD and OSD shall have the authority to:
    • Dishonorably discharge and demote personnel;
    • Demerit and promotion lock personnel; and,
      • Members of the JSD may only issue demerits and promotion locks to personnel in their office or branch.
    • Issue other Non-Judicial Punishments following the conditions outlined in this Regulation.
    Disciplinary actions issued by members of the OSD are at their discretion.
    • Existing pardon policies are not affected by this provision and shall be carried out without modification.
    • Appeals of disciplinary actions issued by members of the OSD shall require prior approval from the Under Secretary of Defense for Personnel and Readiness (USD P&R).
    SUBSECTION 3. Commissioned Officers
    Commissioned Officers are expected to resolve minor disputes within HQ and maintain good order and discipline in their areas of responsibility, including HQ, their office, and their branch.

    Commissioned Officers shall have the authority to:
    • Dishonorably discharge and demote personnel,
    • Remove FEATs.
    SUBSECTION 4. Office of the Judge Advocate General (OJAG)
    The Office of the Judge Advocate General (OJAG) shall:
    • Act as a check and balance on all disciplinary actions issued by authorized personnel except members of the OSD;
    • Exercise independent authority to review, affirm, modify, or overturn all disciplinary actions;
    • Review, approve, or deny pardons for dishonorably discharged personnel; and
    • Conduct all Judicial Reviews through designated OJAG members acting on behalf of the JAG.
    Members of the OJAG may issue any disciplinary measure outlined in this Regulation, provided such action is consistent with the standard operational procedures and jurisdiction of the justice system.

    Section 2. Disciplinary Actions
    The USDF applies two types of Disciplinary Actions: Punitive Discharges and Non-Judicial Punishments.

    Punitive Discharges are disciplinary actions that permanently separate a member from the USDF. A dishonorably discharged individual may not be reinstated without an approved pardon by the OJAG. Punitive discharges include Dishonorable discharges, Executive discharges, and the Never Rehire status.
    • An Executive Discharge and the Never Rehire status represent more severe forms of a Dishonorable discharge.
    • Punitive discharges shall be issued in accordance with provisions established in Regulation 4: Discharges, Reinstatements, and Transfers.
    Non-Judicial Punishments are disciplinary actions that do not warrant a complete discharge of a service member.
    • Non-Judicial Punishments include, but are not limited to:
      • Demotions;
      • Promotion locks;
      • Demerits; and,
      • Removal from command positions, removal from OCS, removal of FEATs, or removal of privileges.
    All Commissioned Officers who are on active duty have the authority to issue disciplinary actions for Articles 1, 2, 3, 4, 5, 11, 22, and 26, provided that conditions for specified articles listed in Chapter 2 of this Regulation have been met.

    Personnel may be subject to any disciplinary action deemed appropriate, provided that such action is proportionate to the offense, as determined by the specific facts and circumstances of each individual case.
    • Personnel who believe that a disciplinary action was unjust or disproportionate may submit an appeal to the OJAG, in accordance with the provisions outlined in Chapter 3 of this Regulation. 
    SUBSECTION 1. Demotions and Promotion locks
    Demotions shall be defined as reductions in rank, imposed as a disciplinary action in response to serious or repeated violations of policy.

    Commissioned Officers may not issue a demotion exceeding one rank. In cases where the nature or severity of the infraction warrants consideration of a greater reduction in rank, the matter must be referred to the OJSIG through the appropriate reporting procedures outlined in Procedure 4: Complaint Forms (ARF, PAF, DRF, GRF, FCF).

    Promotion locks are restrictions that temporarily prevent a service member from being promoted. Promotion locks may be imposed as a consequence of policy violations, performance concerns, or other grounds as outlined in Regulations.

    Demotions and Promotion locks must be issued in accordance with applicable provisions outlined in Regulation 5: Promotion, Demotion and Discharge Requirements.

    SUBSECTION 2. Demerits
    Demerits are warnings that are permanently on record.

    Demerits shall expire 60 days from the date of issuance. If another demerit for the same type of offense is issued within that period, the expiration timeframe shall reset and start over from the date of the most recent offense.
    • Exceptions apply to SoW/MPTS posting errors, for which demerits shall expire after 30 days. If another SoW/MPTS posting demerit is issued within that time, the expiration period shall extend by an additional 30 days from the date of the latest offense.
    • Accumulated demerits shall contribute to the progressive disciplinary system outlined in Table 1. Disciplinary measures based on the accumulation of demerits.
    Members of the OJAG, OSD, and the NSC may, at their discretion, move active demerits to an inactive status. The JSIG may, following consultation with the JAG, reduce or move demerits to inactive status in recognition of good behavior.
    • Inactive demerits shall no longer accumulate.
    Personnel who accumulate 3 or more active demerits shall have their behavioral history and past infractions reviewed by the OJSIG to determine whether further action is warranted. This review does not automatically result in additional disciplinary measures.
    • Personnel who are issued demerits following a pardon for a dishonorable discharge, where the discharge resulted from the accumulation of 6 demerits, shall be subject to a disciplinary review conducted by the JSIG. Such a review may serve as grounds for further disciplinary action.
    Assistant Directors (ML1) of offices must be included as recipients on all demerit slips. If the Assistant Director (AD) role is vacant, the Director shall be included.
    • If an ML2+ command member is being issued a demerit, the command member directly above them in the chain of command must be included as a recipient.

    Displaying a lack of courtesy towards service members or civilians while in uniform and on duty.
    ARTICLE 3.
    Failure to Obey an Order or Regulation

    Any individual who willingly disregards a lawful order, regulation, code of conduct, or section of legislation.
    ARTICLE 4.
    Insubordination

    Any individual who (1) willfully disobeys the lawful order of a superior officer, warrant officer, or non-commissioned officer, or
    (2) treats with contempt or is disrespectful toward an officer, warrant officer, or non-commissioned officer.
    ARTICLE 5.
    Improper Wear of Uniform

    Intentionally disregarding proper uniform wear outlined in Regulation 2 while on duty in HQ.
    ARTICLE 6.
    Absent Without Leave (AWOL)

    Enlisted members (E1 to E3) who fail to log in for 14+ consecutive days.
    E4+ who fail to log in for 10+ consecutive days.
    ARTICLE 7.
    Double Jobbing

    Any individual employed at another military organization, agency, or group on Habbo.com, other servers (e.g., .nl, .de), or retro servers, while in any duty status at USDF.
    Enrolling in organizations under an incognito status is not permitted. 
    ARTICLE 8a.
    Desertion

    Any individual E4 and above who, without filing a proper resignation or retirement, leaves the USDF Personnel ID and the primary communication platform (e.g., Discord).
    ARTICLE 8b.
    Quit
    NSC

    Any enlisted member (E1 to E3) who, without being properly discharged, enlists or accepts an appointment in any foreign military or agency, or removes their USDF motto and badge. This results in an honorable discharge.
    ARTICLE 9.
    Account Compromised/Account Insecurity

    Any unauthorized access to an individual's Habbo, email, forum, PTS, or Discord account, the results of which are due to the individual's actions.
    ARTICLE 10.
    Misconduct towards Foreign Entities

    Engaging in any acts that may bring discredit upon the organization or military as a whole while interacting with foreign personnel.

    Malingering

    ARTICLE 12a.
    Falsification

    Any individual who, with intent to deceive, makes a false record, report, forum post, or official statement, knowing it to be untrue.
    ARTICLE 12b.
    Cloning

    Any individual who, without approval, uses more than one account in the United States Defense Force.
    This includes any name changes made to accounts.
    ARTICLE 13a.
    Harassment

    Any verbal or non-verbal unwanted conduct that is intended to, or effectively does, violate a person's dignity, causing fear, a hostile, humiliating, or offensive environment.
    ARTICLE 13b.
    Sexual Misconduct

    Any verbal or non-verbal conduct of a sexual nature that is intended to, or has the effect of, violating a person’s dignity and creating an intimidating, hostile, degrading, humiliating, or otherwise offensive environment.
    ARTICLE 14.
    Discrimination

     Any act or omission based on race, color, religion, sex, national origin, age, disability, sexual orientation, gender identity, or protected activity that negatively affects employment opportunities, treatment, or conditions, or results in disparate impact or treatment.
    ARTICLE 15.
    Fraternization

    An unduly familiar personal relationship between a senior and a subordinate that does not respect the difference in rank or grade. Relationships between a senior and a subordinate that are prejudicial to good order and discipline or of a nature to bring discredit on our service are unduly familiar and also constitute fraternization.
    ARTICLE 16.
    Abuse of Authority

    Any individual who uses their position to gain unfair advantages, coerces subordinates into following unlawful orders, misuses privileges granted to them on official USDF platforms, or vandalizes any property of the USDF.
    ARTICLE 17a.
    Violation of Secrecy

    Any individual, including those who have retired, resigned, or been otherwise discharged, who breaches operational security by disclosing classified or sensitive information in any form, regardless of intention.
    Any individual, including those who have retired, resigned, or been otherwise discharged, who leaks non-public information through any means.
    ARTICLE 17b.
    Treason

    Any individual who, with intent to usurp or override lawful authority, refuses to obey standing orders or otherwise perform their duty, or creates any disturbance or revolt.
    ARTICLE 18.
    Espionage

    Any individual who, with intent or reason to believe that it is to be used to the injury of the United States Defense Force or the advantage of a foreign military or agency, communicates, delivers, or transmits, or attempts to communicate, deliver, or transmit, either directly or indirectly, any non-public information.
    ARTICLE 19.
    Hazing

    Any conduct by which one individual causes another military member to endure or be subjected to cruel, abusive, humiliating, or oppressive actions or treatment.
    ARTICLE 20.
    Larceny

    Any individual who wrongfully takes, obtains, or withholds, by any means, from the possession of the owner, any money, credits, personal property, or article of value.
    ARTICLE 21.
    Extortion, Blackmail
    NSC

    Any individual who communicates threats to another member with the intention of obtaining anything of value or any acquittance, advantage, or immunity.
    ARTICLE 22.
    Conduct Unbecoming

    All O1+
     Any individual who conducts themselves in a poor and unbecoming manner, thereby bringing disrepute to the United States Defense Force.
    ARTICLE 23.
    Perjury

    Any individual who, in punitive or judicial proceedings, willfully and corruptly provides false information after swearing or affirming to tell the truth.
    ARTICLE 24.
    Mutiny, Sedition, Conspiracy

    Hosting or partaking in a rebellious act against military authority. Conspiring or aiding individuals to usurp military justice and authority.
    ARTICLE 25.
    Cheating and Plagiarism

    Any individual who knowingly engages in or facilitates cheating or misrepresentation in written work, including but not limited to: discussing questions, using leaked answers, soliciting or providing information on examinations, employing artificial intelligence technologies in written applications, interviews, appeals, pardons, or expressions of interest, or falsely claiming credit for work they did not create or are not responsible for.
    ARTICLE 26.
    Unfit for Duty

    Any individual considered unable to perform their duties due to behavioral issues, incompetence, unwillingness to work, or any other inappropriate action as determined by the issuing authority.
    ARTICLE 27.
    Defamation

    Any intentional or unintentional act by an individual that harms the reputation of USDF personnel, offices, the Secretary of Defense, or the organization as a whole, thereby bringing them into disrepute.
    ARTICLE 28.
    Evasion of Punishment

    Any individual who attempts to avoid the consequences of disciplinary action through resignation, retirement, inactive reserves duty (R2), or other means within 7 days of disciplinary action or within 7 days of receiving an appeal verdict.
    This does not apply to personnel who have planned leave of absence, or those who received disciplinary action for missing the Standard of Work.
    ARTICLE 29.
    Contempt of Court

    Any individual who displays disrespect or disdain toward disciplinary or appeal verdicts in a public or private capacity.
    ARTICLE 30.
    Obstructing the Course of Justice

    Any individual who, during a judicial proceeding or in the administration of justice, interferes with or prevents the proper execution of justice. This includes any form of non-cooperation when called upon to assist in an official investigation.
    ARTICLE 31.
    Bribery

    Any individual who offers, accepts, or solicits something of value in return for some influence or action.
    ARTICLE 32.
    Illegal Advertisement

    OJSIG
    Any act by an individual involving the distribution of links or materials to official USDF platforms that are illegal, malicious, or intended for personal financial gain, as well as any direct or indirect attempt to poach members or promote other organizations.
    ARTICLE 33.
    Practice or Endorsement of Illegal Warfare

    Any act by an individual involving the participation in or promotion of unlawful warfare tactics, including but not limited to cybercrimes such as doxing, DDoS attacks, or phishing.
    1 - OMP AD+ is authorized to issue disciplinary action under Article 12a only when the offense involves a selectee.
    2 - OJAG is authorized to issue disciplinary action under Article 25 only in cases involving a Pardon, NR Review, or Punishment Appeal Form.


    CHAPTER 3. APPEALS AND PARDONS

    Section 1. Disciplinary Action Appeals
    Personnel subject to disciplinary action under this Regulation have the right to appeal both Non-Judicial Punishments and Punitive Discharges through established appeal procedures outlined in this Regulation and Procedure 4: Complaint Forms (ARF, PAF, DRF, GRF, FCF).

    Disciplinary actions may be appealed on the grounds that they were unlawful or disproportionate.
    • A disciplinary action is considered unlawful when it violates existing regulations, exceeds the authority of the issuing individual, or is issued without sufficient evidence.
    • A disciplinary action is considered disproportionate when the severity of the punishment exceeds what is appropriate in relation to the circumstances of the offense.
    Upon successful appeal, disciplinary actions may be partially or completely overturned, and corrective measures may be ordered.

    SUBSECTION 1. Discharge Appeals
    Personnel who have been discharged from the USDF may appeal such action within 7 days from the date of their discharge.

    All discharge appeals must be submitted through the Punishment Appeal Form (PAF) located on the Personnel Tracking System (PTS).

    Personnel whose discharge appeals are granted shall:
    • Retain all demerits accumulated during their original term in the USDF;
    • Have their service time amended to correct any loss of service days; and,
    • Be restored to their previous rank unless otherwise specified in the appeal decision.
    Section 2. Pardon Process
    Pardons may be granted for punitive discharges where circumstances justify a second chance or where errors in the original disciplinary process are identified, provided that more than 7 days have passed since the date of discharge.

    Following the denial of a pardon, the applicant must wait 14 days before submitting a new pardon request.
    • The waiting period may be modified at the discretion of the JAG.
    Following approval of a pardon, the original discharge shall be modified to either General Discharge (GD) or Honorable Discharge (HD) at the discretion of the OJAG.
    • Individuals whose pardons are approved may consult with a Judge Advocate regarding potential reinstatement to the USDF.
    • Personnel seeking reinstatement following an approved pardon shall comply with the return conditions established in Regulation 4: Discharges, Reinstatements, and Transfers, as well as additional conditions established at the discretion of the OJAG.
