    Regulation 4: Discharges, Reinstatements, and Transfers

    CHAPTER 1. HONORABLE DISCHARGES
    Subsection 1. Resignations
    Removed (Repeated Information): OMP AD+ can deny resignations and retractions at their discretion.

    Commissioned Officers are required to inform their Branch Chief and the CJCS of their intent to retire, and before posting their retirement, inform the SecDef. In the event the SecDef is unavailable, the DepSecDef must be notified will be utilized in place. All retirement packages will be negotiated with the SecDef and will be logged on the user's PTS profile as applicable.

    OSD members must send notice to their respective chain of command at least 7 days a week before resigning.

    Subsection 2. Retirements
    Commissioned Officers that retire before 3 months since their commission will be allowed to return up to a maximum rank of W5, unless an exception is made by the NSC.

    Reinstated Commissioned Officers must have reinstated for a minimum of 90 days in order to be eligible for a new retirement package from the SecDef Secretary of Defense or DepSecDef Deputy Secretary of Defense. Exceptions to this rule may be made by the SecDef Secretary of Defense on a case by case basis.

    Subsection 3. Promotion Time Out (PTO)
    Enlisted personnel discharged for UCMJ Articles 6, 7, and 8b will be granted an Honorable Discharge.
    CHAPTER 2. DISHONORABLE DISCHARGES

    Subsection 1: Dishonorable Discharge

    Discharge Procedure:
    File a DRF on the PTS with the JAG.
    A DRF is required for individuals that have held the paygrade are ranked E4+ at the time of their discharge.

    Subsection 2. Never Rehire Status
    The status of Never Rehire can only be issued by personnel ranked JSD+.
    CHAPTER 4. REINSTATEMENT POLICIES

    Personnel who resigned as NCOs and CWOs who are seeking reinstatement may speak with any Commissioned Officer from the OMP, regardless of position within the aforementioned office.

    Personnel reinstating will lose SRIMMI/GPI/FTI status and will have to redo the test.

    Subsection 2. Reinstatement Following Resignation or other HD

    Warrant Officers who lose FEAT {W} on reinstatement will be temporarily reinstated to E-9. On completion of FEAT {W}, they should seek out a member of OMP command who will then fully process their reinstatement back into the CWO ranks following policy.

    Subsection 3. Reinstatement Following a Pardon

    Personnel will lose their SRI/GPI/FTI status and will have to redo the test.
    CHAPTER 5. TRANSFER POLICIES
    Subsection 1. Authorization for External Transfers

    The DMP and OMP ML1 ADs reserve the right to deny transfers at their discretion.

    Subsection 2: External Transfer Conditions restrictions apply.
    SEL and Final Rank Issuing Authority:

    Officer Selectees (OFF/SEL) who are permitted to join an office, may host relevant FEATs/PTPs/FTIs of said office in accordance to Training: Further Education and Training (FEATs), Training: Practical Training Programs (PTPs) and Field Training Exercises (FTXs) upon receiving MMISRI/GPI/FTI.

    CHAPTER 4. REINSTATEMENT POLICIES
    Subsection 3. Reinstatement Following a Pardon

    Old Information:

    • Only members of OJAG are permitted to reinstate personnel following an accepted pardon.
    • The terms of reinstatement following a pardoned discharge are offered at the discretion of the JAG.
      • Any personnel returning to USDF after a pardoned discharge will be subject to having their Service Time reset.
      • Personnel may also lose any/all of their FEATs and medals.
      • Personnel will lose their SRI/GPI/FTI status and will have to redo the test.
    • Members of OJAG may offer up to rank E4 with the loss of FEATs {BSMNJQLWXZO} and a full statistics reset for the first reinstatement.
    • The second reinstatement obligates personnel to return as rank E1, losing all FEATs and medals as well.
    • Any alteration to the appeals above will require approval from a member of NSC.


    New Information:

    The United States Defense Force (USDF) is dedicated to upholding the principle of "second chances," a tradition that has been honored throughout our ten-year history. We acknowledge that individuals can grow and learn from their past mistakes. However, we also maintain strict reinstatement measures for those who have committed significant violations of the UCMJ. For those found guilty of treason or other severe UCMJ violations, a Never Rehire status may be enforced. Our policy on reinstatement following a pardon is detailed below:

    Reinstatement of personnel following a pardon is exclusively managed by OJAG. The terms of reinstatement after a pardoned discharge are determined at the discretion of the JAG and may include the following options:

    • Full Reset: This option involves a complete reset of a member’s Service Time, Service Stripe, Awards/Medals, FEATs, and all USDF educational milestones (FEAT L, FEAT W, SRI/GPI/FTI, OCS, SOAB, SODC, FGOAB). This action effectively resets the member’s entire record within the USDF and is typically reserved for those who have committed significant UCMJ violations but have been granted a pardon for another opportunity to serve.

    • Reset: This option is a modified version of the Full Reset with slightly less strict requirements. It includes a reset of Service Time, Service Stripe, and higher education USDF Progression (OCS Preparation, SOAB, SODC, FGOAB). Members subject to a 'Reset' will retain the medals they earned during their previous tenure, despite the other listed categories being reset.

    Additional Notes:
    • If a member has received two or more pardons during their USDF career, they are highly likely to be subject to one of the two options above, depending on the severity of their UCMJ violations related to their most recent pardon.
    • Anyone pardoned from a "Never Rehire" status will automatically be subject to one of the two resets. Only the SecDef and DepSecDef have the authority to waive this clause.

    Each reinstatement case is guaranteed a fair and impartial evaluation without interference. However, it is important to note that the SecDef has the ultimate authority to overrule the JAG's decision on a pardon ruling and reserves the right to issue an executive pardon for any member as they seem fit.

    When promoting someone to rank E4, they must receive the E4 Training promotional procedure immediately after from their promoter or a qualified individual E9+ command +.

    To determine the RST/MST for a certain rank, utilize tables 3A & 3B. Look at the row that denotes the RST/MST for the specific promotion in question. For example, if you are an E8 looking for your RST to be promoted to E9, look at the row with the pay grade "E8 to E9", and denote the RST 50 days / 7.25 weeks as 7 weeks. If you are a W2 looking for your MST, look at the row with the pay grade "W2", and denote the MST as 147 days / 21 weeks (5.25 months) as 12 weeks.

    For reinstated personnel, all previous service time is kept and is taken in account for all future promotions. Those who were Dishonorably Discharged, however, have their service time is reset.
